David Motley Ellington was born on 13 Jan 1759 in Amelia County, Virginia. He appeared on the census in 1810 in Greenup County, Kentucky. He appeared on the census in 1820 in Greenup County, Kentucky. He died in 1846 in Crittendon County, Tennessee.

Indenture

This indenture made entered into 22 day of October 1821 between David
Ellington of Greenup County, KY of the due part and William Dupuy of the
same county and state Withesseth that whereas for causes not necessary
herein to be named the said David Ellington and Mary his wife have seen
proper heretofore to separate and agree to live apart during the residue
of their lives and whereas the Mary Ellington, wife of the said David,
have hereto instituted her suit in chancery for alimony and separate
maintenanceand whereas it is agreed and thought proper by the said
David to allow his and said wife and to her use and benefit forever the
property hereinafter to be mentioned and described as for separate
maintenance for her life to be disposed by her as she shall see proper
either at or before her death and the said Mary Ellington of her own
choice as well as from the choice of said William Dupuy her brother
agrees to accept said property herein after to be mentioned in the
discharge of all claims that she said Mary now or at any time hereafter
upon the said David her husband for alimony dower and other rights
accruing or arising by virtue of said Mary now the said David in
consideration of the premisis and for and in further consideration of
the sum of $1 to the said David and had paid by said William Dupuy at and
before the sealing and delivery of these presence the receipt whereof is
hereby acknowledged have granted, bargained and assign to the said Wm.
Dupuy and does by these presence sell set over and assign to him the
following property and promissory notes as well as all rights and
benefits to be mentioned to wit:

1 Negro woman slave named Anaka and her child named Samson and all
right and interests of said David may and might have to every part of
the estate whether personal or real of Peter Dupuy the father of said Mary
Ellington deceased and also claim right and interest that said David
might have in or upon the estate of Elizabeth Dupuy mother of the said
Mary who is also deceased with full power to take any measures either
in law or equity to recover and keep himself of the same.

Hereby conveyed or intended to be connveyed to said Wm. Dupuy
...wherever free from the claims of said David...... hereby convey or
intended to be conveyed that said Mary may see proper to do and in the
case the said William shall receive any money or other property
whatever from the estate of Peter Dupuy deceased or said Elizabeth
Dupuy deceased that her(?) the said Wm. will allow and permit the said
Mary to use and enjoy said money or other property at her pleasure.
